James L. Wells pleads guilty to attempted possession of child pornography

DECATUR, Nov 04, 2009 (Herald and Review - McClatchy-Tribune Information Services via COMTEX) -- James L. Wells, 25, of Decatur pleaded guilty Tuesday to an amended charge of attempted possession of child pornography under a partial plea agreement with the Macon County State's Attorney's Office.

Circuit Judge Lisa Holder White accepted the guilty plea and scheduled a sentencing hearing for Dec. 4. She said Wells could receive a term of probation, a fine up to $25,000 or a prison term of three to seven years when he is sentenced.

The amended charge alleged Wells possessed a computer video file of a male child under the age of 18 who was engaged in a sexual act.

In a sworn statement filed in court, Decatur police detective Jeremy Welker said, on June 6, he identified a computer with an Internet protocol address that was found to belong to Wells. He said the address was being used to distribute child pornography via a person-to-person computer network.

Seven additional checks were made on the computer address during July, Welker said. The computer was found to contain at least eight files of identified child pornography in a shared file folder, he said.

Detectives served a search warrant July 29 at Wells' residence in the 1900 block of East North Street. Welker said they found in a bedroom a computer belonging to Wells that had a file-sharing program running and from which files of suspected child pornography were being uploaded by other unknown people.
